《中华人民共和国外商投资法》自2020年1月1日起施行，共分6章，包括总则、投资促进、投资保护、投资管理、法律责任、附则，共42条。《中华人民共和国外商投资法实施条例（草案）》，也将同步配套实施。

新法明确“国家对外商投资实行准入前国民待遇加负面清单管理制度”，取消了逐案审批制管理模式；同时明确了，外商投资企业依法平等适用国家支持企业发展的各项政策；国家建立健全外商投资服务体系；国家保障外商投资企业依法平等参与标准制定工作、通过公平竞争参与政府采购等。
The Interpretation of the Supreme People's Court on Several Issues concerning the Application of the Foreign Investment Law of the People's Republic of China, as adopted at the 1787th meeting of the Judicial Committee of the Supreme People's Court on December 16, 2019, is hereby issued, and shall come into force on January 1, 2020.
