人社部拟规范社保领域严重失信“黑名单”管理

人力资源和社会保障部办公厅发布《社会保险领域严重失信“黑名单”管理暂行办法(征求意见稿)》(下称《征求意见稿》),现向社会征求意见,意见反馈截至10月25日。The General Office of the Ministry of Human Resources and Social Security ("MOHRSS") has recently issued the Interim Administrative Measures for the Social Insurance Blacklists for Serious Discreditable Conduct (Draft for Comment) (the "Draft for Comment") for public comment by October 25, 2018.
近日,人力资源和社会保障部办公厅发布《社会保险领域严重失信“黑名单”管理暂行办法(征求意见稿)》(下称《征求意见稿》),现向社会征求意见,意见反馈截至10月25日。

《征求意见稿》规定,社保“黑名单”实行“谁列入、谁管理、谁负责”,遵循依法依规、公平公正等原则。有“用人单位未按相关规定参加社会保险且拒不整改”等情形之一的单位或个人,县级及以上社会保险经办机构应将其列入“黑名单”。《征求意见稿》明确,各级社会保险经办机构应将社保“黑名单”信息纳入当地和全国信用信息共享平台,由相关部门在各自职责范围内依据《关于对社会保险领域严重失信企事业单位及其有关人员实施联合惩戒的合作备忘录》规定,在政府采购、交通出行、招投标、生产许可、资质审核、融资贷款、市场准入、税收优惠等方面予以限制。

The General Office of the Ministry of Human Resources and Social Security ("MOHRSS") has recently issued the Interim Administrative Measures for the Social Insurance Blacklists for Serious Discreditable Conduct (Draft for Comment) (the "Draft for Comment") for public comment by October 25, 2018.

The Draft for Comment provides that, an authority making a social insurance blacklist shall make and manage the list and be held accountable for the list in accordance with laws and regulations as well as the principle of fairness and justice. In any of the circumstances including that "where the employer fails to participate in the social insurance scheme as required and refuses to remedy the violation", the entity or any individual concerned shall be blacklisted by the competent social insurance agency at or above the county level. The Draft for Comment also expressly states that, all levels of social insurance agencies shall incorporate the information in their social insurance blacklists into the local and national credit information sharing platform, and the relevant departments will impose restrictions within their duties and powers on those blacklisted in respect of government procurement, traveling, tendering and bidding, production licensing, qualification accreditation, financing and borrowing, market access, tax incentives, etc., in accordance with the Memorandum of Understanding on Taking Joint Disciplinary Actions against Enterprises and Public Institutions and Their Relevant Personnel with Serious Discreditable Conduct in the Area of Social Insurance.
